Welcome to HUMANARTY. This website (humanarty.org) is owned and operated by HUMANARTY Limited ( "the Company," "we," "us," or "our"). By accessing our site and/or purchasing from us, you engage in our “Service” and agree to be bound by the following terms and conditions.

1. THE SERVICE

HUMANARTY provides a curated marketplace connecting artists, collectors, and technologists. We facilitate the display and sale of physical and digital artworks, including those involving artificial intelligence and robotics.

2. INTELLECTUAL PROPERTY RIGHTS

Our Property: All content on this site, including but not limited to the HUMANARTY™ name, logo, site design, text, and graphics, is the exclusive property of the Company and is protected by UK, HK, and international copyright and trademark laws.
Artist Property: Artwork displayed is the intellectual property of the respective artists or the Company. Purchase of a physical piece of art does not grant the buyer any copyright or reproduction rights unless explicitly stated in a separate written agreement.

3. ACCURACY OF INFORMATION & PRICING

Representations: We make every effort to display the colors and images of artworks accurately. However, we cannot guarantee that your monitor's display will be 100% accurate to the physical work.
Pricing: All prices are subject to change without notice. We reserve the right to refuse or cancel any order placed at an incorrect price.

4. PAYMENTS & TRANSACTIONS

Security: Payments are processed via secure third-party gateways (e.g., Shopify Payments, Stripe). We do not store full credit card details.
High-Value Art: For transactions exceeding $10,000 USD, we reserve the right to request additional "Know Your Customer" (KYC) documentation to comply with international anti-money laundering (AML) regulations.

5. SHIPPING, INSURANCE, & RETURNS

Shipping: Shipping costs and estimated delivery times are provided at checkout. High-value items are shipped via specialized art couriers.
Insurance: Title and risk of loss pass to the buyer upon delivery to the carrier. We highly recommend purchasing additional transit insurance for high-value items.
Returns: Given the unique nature of fine art, all sales are Final unless the work arrives damaged. Damage must be reported within 48 hours of receipt with photographic evidence.

6. LIMITATION OF LIABILITY

To the maximum extent permitted by law, HUMANARTY Ltd and its directors shall not be liable for any indirect, incidental, or consequential damages (including lost profits or "emotional distress") arising from the use of our site or the purchase of any artwork. Our total liability to you for any claim shall not exceed the amount paid for the item in question.

7. USER CONDUCT

You agree not to:

Reproduce, duplicate, or sell any portion of the Service without express written permission.
Use the site for any unlawful purpose or to solicit others to perform unlawful acts.
Upload viruses or malicious code.

8. GOVERNING LAW & JURISDICTION

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts Hong Kong SAR (at the Company’s sole discretion).
